Practice Examination Questions: We provide extensive collections of practice questions for major Nigerian examinations including WAEC (West African Examinations Council), NECO (National Examinations Council), UTME (Unified Tertiary Matriculation Examination), and PUTME (Post-UTME). Our question banks are regularly updated to reflect the latest examination patterns and syllabi, ensuring students have access to the most current and relevant practice materials.

AI-Powered Question Solving Tools: Our advanced artificial intelligence system provides intelligent question-solving assistance, offering step-by-step explanations, alternative solution methods, and personalized learning recommendations. This AI technology adapts to each student's learning style and pace, providing targeted support where it's needed most.

Mock Examination Simulations: We offer realistic computer-based test (CBT) simulations that replicate the actual examination environment. These simulations help students become familiar with the examination format, time constraints, and question types, reducing anxiety and improving performance on the actual exam day.

3. User Accounts and Registration

To access the full range of features and services offered by EPass Africa, you must create a user account. Account creation is a straightforward process that requires you to provide certain personal information to establish your identity and enable us to deliver personalized educational services.

Information Accuracy: When creating your account, you must provide accurate, current, and complete information about yourself. This includes your full name, email address, phone number, date of birth, and educational institution. Providing false or misleading information may result in account suspension or termination, as it undermines the integrity of our educational platform and may affect other users' experiences.

Account Maintenance: You are responsible for maintaining and updating your account information to ensure it remains accurate and current. This includes updating your contact information if it changes, modifying your educational preferences, and keeping your profile information up to date. We may periodically request verification of your information to maintain account security and service quality.

Password Security: You must keep your account password secure and confidential. This means choosing a strong, unique password that you do not share with others, and changing it regularly. You are responsible for all activities that occur under your account, whether authorized by you or not. If you suspect that your account has been compromised, you must notify us immediately so we can take appropriate security measures.

Account Responsibility: You accept full responsibility for all activities that occur under your account, including any content you post, questions you answer, or interactions you have with other users. This responsibility extends to ensuring that your use of the account complies with these Terms of Service and all applicable laws and regulations.

3.2 Age Requirements

Our platform is designed to serve students of various ages, but we have specific age requirements to ensure compliance with applicable laws and to protect younger users. You must be at least 13 years old to create an account and use our Service independently.

Parental Consent for Minors: Users under 18 years of age must have parental or guardian consent to use our Service. This includes using our resources to prepare for WAEC, NECO, UTME, PUTME, and other recognized examinations. You may use our platform to supplement your formal education and enhance your learning outcomes.

Accessing Authorized Content and Features: You may access and use all content and features that are made available to you based on your subscription level and account status. This includes practice questions, study materials, progress tracking tools, and other educational resources that are part of our Service.

4.2 Prohibited Uses

To maintain the integrity of our platform and ensure a positive experience for all users, certain activities are strictly prohibited. Violation of these prohibitions may result in immediate account suspension or termination.

User Safety: You must not harass, abuse, threaten, or harm other users in any way. This includes bullying, intimidation, or any form of inappropriate behavior that creates an unsafe or uncomfortable environment for other users.

Platform Integrity: You must not interfere with the proper functioning of our Service, including attempting to overload our systems, disrupt our operations, or interfere with other users' ability to access and use our platform.

5. Subscription and Payment Terms

Our subscription and payment terms are designed to provide flexible access to our educational services while ensuring fair and transparent pricing. We offer multiple subscription options to accommodate different learning needs and budgets.

5.1 Pricing Plans

Pay-as-you-go Plan: Our flexible pay-as-you-go option allows you to purchase access to specific examinations at ₦150 per exam unlocked. This plan is ideal for students who want to focus on specific examinations or who prefer to pay only for what they use. Once you purchase access to an exam, you retain that access permanently, allowing you to practice and review questions at your own pace.

Annual Elite Plan: Our comprehensive annual plan provides unlimited access to all examinations and features for ₦6,000 per year. This plan offers the best value for students who plan to use our platform extensively and want access to all available content, including WAEC, NECO, UTME, and PUTME questions, as well as premium features like AI-powered question solving and advanced analytics.

5.2 Payment Terms

Payment Processing: All payments are processed through secure, industry-standard third-party payment processors that comply with PCI DSS requirements. We do not store your complete payment card information on our servers, ensuring maximum security for your financial data.

Authorization and Billing: By subscribing to our Service, you authorize us to charge your designated payment method for applicable fees. This authorization remains in effect until you cancel your subscription or change your payment method. You are responsible for ensuring that your payment method has sufficient funds and is valid.

Non-Refundable Fees: All fees are generally non-refundable unless otherwise stated in these Terms or required by applicable law. This policy reflects the nature of digital content and services, where access is provided immediately upon payment and cannot be "returned" in the traditional sense.

Pricing Changes: We reserve the right to change our pricing with 30 days' advance notice. We will notify you of any price changes through email or prominent notice on our platform. Price changes will not affect your current subscription period, but will apply to renewals and new subscriptions.

Payment Failures: If a payment fails due to insufficient funds, expired payment method, or other reasons, we may suspend your access to premium features until payment is successfully processed. We will attempt to notify you of payment failures and provide opportunities to update your payment information.

5.3 Refund Policy

General Policy: Refunds are generally not provided for digital content and services, as access is granted immediately upon payment and the content cannot be "returned." This policy is consistent with industry standards for digital educational platforms and reflects the immediate value provided upon subscription.

Exceptional Circumstances: We may consider refunds in exceptional circumstances at our sole discretion, such as technical issues that prevent access to our Service, billing errors on our part, or other situations where we determine that a refund is appropriate. Each refund request is evaluated on a case-by-case basis.

Refund Process: If you believe you are entitled to a refund, please contact our customer support team at hello@epass.africa with a detailed explanation of your circumstances. We will review your request and respond within a reasonable timeframe.

Chargeback Policy: If you initiate a chargeback or dispute with your payment provider without first contacting us, we may suspend your account and take appropriate action to recover the disputed amount. We encourage you to contact us directly to resolve any payment issues before initiating a chargeback.

6. Intellectual Property Rights

Intellectual property rights are fundamental to our platform and the educational content we provide. This section outlines the ownership and usage rights for all content on our platform, ensuring clarity about what belongs to whom and how content may be used.

6.1 Our Content

Platform Ownership: The EPass Africa Service, including its original content, features, functionality, design, and underlying technology, is owned by EPass Africa and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes our website, mobile applications, software, algorithms, databases, and all educational content we create.

Educational Content: All practice questions, study materials, explanations, tutorials, and other educational content created by EPass Africa are our proprietary intellectual property. This content is the result of significant investment in research, development, and educational expertise, and is protected by copyright and other intellectual property laws.

Technology and Algorithms: Our AI-powered question solving tools, analytics systems, and other technological innovations are proprietary to EPass Africa. These systems represent valuable intellectual property that we have developed to enhance the educational experience and are protected by patents, trade secrets, and other intellectual property protections.

Brand and Trademarks: The EPass Africa name, logo, and other brand elements are trademarks owned by EPass Africa. These trademarks are protected by law and may not be used without our explicit written permission.

6.2 User Content

User Ownership: You retain ownership of any content you create, upload, or contribute to our platform, including comments, feedback, study notes, and other user-generated content. We respect your intellectual property rights and do not claim ownership of your original content.

License to EPass Africa: By using our Service and contributing content, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, display, and distribute your content for the purpose of providing and improving our Service. This license allows us to incorporate your feedback into our platform, respond to your inquiries, and enhance our services based on user input.

Content Moderation: We reserve the right to review, moderate, and remove user content that violates these Terms of Service or is otherwise inappropriate. This includes content that is offensive, harmful, infringing, or violates applicable laws or regulations.

Examination Changes: Examination boards may change their formats, syllabi, or requirements without notice. While we strive to keep our content current, we cannot guarantee that our materials will always reflect the most recent examination changes.

9.3 Limitation of Liability

General Limitation: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPASS AFRICA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Direct Damages: Our total liability for any direct damages arising from your use of our Service shall not exceed the amount you have paid us in the twelve months preceding the event giving rise to the claim, or one hundred dollars (₦100), whichever is greater.

Educational Damages: We are not liable for any educational outcomes, exam results, or academic consequences that may result from your use of our Service. This includes poor exam performance, missed opportunities, or any other educational setbacks.

Third-Party Actions: We are not liable for any damages resulting from the actions of third parties, including other users, service providers, or external websites that may be linked to or integrated with our platform.

Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, cyber attacks, or other force majeure events.

10. Indemnification

This section outlines your responsibility to protect EPass Africa from certain types of claims and legal actions that may arise from your use of our Service. Indemnification is a legal concept that requires you to compensate us for certain losses or expenses we may incur.

Your Indemnification Obligation: You agree to indemnify and hold harmless EPass Africa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service or violation of these Terms.

Scope of Indemnification: This indemnification obligation covers claims arising from your use of our Service, including but not limited to claims related to your content, your violation of these Terms, your violation of applicable laws, or your infringement of third-party rights. Survival: This indemnification obligation will survive the termination of these Terms and your use of our Service, continuing to apply to claims that arise from events that occurred while you were using our Service.

Data Export: Before terminating your account, you may request a copy of your data for your records. We will provide this data in a standard format within a reasonable timeframe after your request.

11.2 Termination by Us

Immediate Termination: We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. This includes violations of our Acceptable Use Policy, fraudulent activities, or other serious misconduct.

Notice and Opportunity to Cure: For less serious violations, we may provide notice and an opportunity to cure the violation before terminating your account. However, we reserve the right to terminate immediately for serious violations or repeated violations.

Service Discontinuation: We may terminate your access to our Service if we discontinue the Service or specific features. In such cases, we will provide reasonable advance notice and, where possible, offer alternative solutions or migration assistance.

Non-Payment: We may suspend or terminate your account for non-payment of fees, after providing notice and opportunity to resolve the payment issue.

Immediate Cessation: Upon termination, your right to use the Service ceases immediately. You will no longer have access to your account, premium features, or any content associated with your account.

Data Deletion: We may delete your account and associated data, including your profile information, study progress, and user-generated content. However, some information may be retained as required by law, for legitimate business purposes, or to resolve disputes.

Subscription Fees: Termination does not entitle you to a refund of any fees already paid, except as required by applicable law or as specified in our refund policy.

Surviving Provisions: Certain provisions of these Terms will survive termination, including intellectual property rights, indemnification obligations, limitations of liability, and dispute resolution provisions.

Reactivation: In some cases, we may allow you to reactivate your account after termination, subject to our approval and any applicable fees or conditions.

This means that Nigerian law will apply to the interpretation and enforcement of these Terms, regardless of where you are located or where you access our Service.

Jurisdiction: Any legal proceedings related to these Terms or our Service will be subject to the jurisdiction of the courts of Nigeria. This provides a consistent legal framework for resolving disputes and ensures that all users are subject to the same legal standards.

International Users: Even if you are located outside Nigeria, these Terms are governed by Nigerian law. This ensures consistency in our legal relationships with all users and provides a clear framework for dispute resolution.

12.2 Dispute Resolution

Arbitration Agreement: Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Nigerian Arbitration and Conciliation Act. Arbitration is a private, efficient alternative to court proceedings that allows disputes to be resolved more quickly and cost-effectively.

Arbitration Process: Arbitration will be conducted by a single arbitrator appointed in accordance with the Nigerian Arbitration and Conciliation Act. The arbitrator will have expertise in the subject matter of the dispute and will conduct the arbitration in English. The arbitration will be held in Nigeria unless otherwise agreed by both parties.

Arbitration Benefits: Arbitration offers several advantages over traditional court proceedings, including faster resolution, lower costs, privacy, and the ability to choose an arbitrator with relevant expertise. The arbitrator's decision will be final and binding on both parties.
